Filing a lawsuit
Filing doesn’t mean trial. It means the insurer must take your case seriously.

When to file
- Offers are too low after a full demand
- The deadline is approaching
- Evidence needs to be obtained by subpoena
What happens after filing
The defendant is served and must answer, generally within 30 days. Then discovery begins.
UM claims: your own insurer generally must be served with a copy of the suit to preserve uninsured motorist coverage.
